I HAVE A RESIDENCE PERMIT, OR I DID UNTIL I CAME BACK TO THE U.S. FOR A MONTH TO SEE MY FAMILY. I HAD TO GET A NEW PASSPORT B/C THE EXPIRATION DATE WAS COMING AND DIDN'T EVEN THINK THAT IT WOULD CANCEL THE RESIDENCE PERMIT THAT I ALREADY HAVE. SO NOW I'M NOT SURE WHAT TO DO. I WAS SUPPOSED TO HEAD BACK ON JULY 21ST BUT THAT IS NOT GOING TO HAPPEN B/C OF HOW LONG IT NOW TAKES TO GET A VISA. SO MY QUESTION, FOR ANYONE WHO THINKS THEY MAY HAVE THE ANSWER, IS CAN I EVEN APPLY FOR A RESIDENCE PERMIT FROM U.S. OR DO I NEED TO JUST APPLY FOR A F VISA FIRST AND THEN WAIT TO TRY AND GET A NEW RESIDENCE PERMIT WHEN I GET BACK TO CHINA? AN F VISA ONLY WILL GIVE ME A 30 DAY VISIT BUT I NEED TO STAY THERE LONGER THAN THAT FOR WORK. SO I'M WORRIED THAT IF I ONLY GET AN F VISA I MAY NOT BE ABLE TO GET THE RESIDENCE PERMIT. ANY THOUGHTS OR SUGGESTIONS WOULD BE APPRECIATED.

Hi Jikora,
If you go back on a F Visa, you will be required to return to the USA before a Z visa can be issued to you. At present moment, you cannot obtain or convert F or L Visas to Z in China. Unfortunately, you cannot obtain a residence permit in any Chinese consulate in the USA. Residence formalities take place (in China) once you have entered China based on the visa type you were given.
Some people have previously suggested that you can try to enter China on your new passport using the visa in your old passport. (you will need both passports) but I am unsure of the result of this and it seems hard to imagine that the customs agents would put an entrance stamp in your old passport.
The best possible solution in this hostile visa environment is to have your company or school apply for the invitation documents again and then apply for the z visa. The problem you will surely experience with this method, is that unlike your previous application you now fall under the terms of the new visa regulations which are not friendly.

Thanks for the info. I have another question for you. I have decided that I will apply for the Z visa. The next problem is that I had already booked my plane ticket to go back before I encountered all of these problems. My return flight back to US isn't until December b/c in the past I had residency and could stay as long as I needed, but now I'm worried that they won't accept my visa application because my return flight isn't for 5 months, even though my plan is to get a new resident permit when I get back to China. Do you think I need to change my plane ticket to show my return much earlier and then change the flight if I get my residence permit. Or do you think I will be ok how it is?

If you have the appropriate invitation documents you will generally not need to show airtickets when you apply for the z visa. I am assuming you are in the USA now and talking about your return flight back from China in approx. six months?
The problam you will have is if that province is sticking on the regulation of foreign experts, because although the requirements have not changed, the enforcement of the regulation has changed and is generally more strict. So the school or company will have to get the invitation documents provided that you are qualified according to the standard of that province.
But if you have done this before you should be fine.. Especially with teaching experience and having lived in China already.

I have a question regarding my current visa situation. I currently have a residence permit that was granted to me off of my sisters residence permit. It expires september 1st and the government told me it would be difficult or that they may not grant me a new residence permit off of my sister again because they didnt want me just hanging out in china. So I am wondering if I should just go ahead and try to renew my residence permit with my sister and her family or do you think the goverment will ask me to leave? I am not sure of the guidelines they use when issuing or renewing residence permits.

What are you doing in China now? Just hanging out? I would recommend trying to get renewed under your sisters visa, but be prepared just in case it doesn't work.
Who knows what is going to happen with new regulations.. its crazy now..

Hello z-visa.com,
I was the originator of this thread and i'm moving along in the process. I just got the official invitation letter from the Chinese gov't, but I have another question for you about the next step in this process. In order to apply for the work visa I need to send a work permit with the rest of my documents. Well, I have a work permit, but if you remember from my previous post, this whole problem came about because I had to renew my passport, so the work permit that I have will have my old passport number on it. My question is do you think this will be a problem when I send my documents in to get my visa? Another quick question, they put Chicago embassy on the offical invitation letter from the Chinese gov't, but I have to apply to the Washington embassy, think that will be a problem

If I understand correctly, the invitation was issued on your former passport number, correct?
It will not be a problem so long as you bring your old passport with you to the consulate and/or provide both to the visa agent, however you decide to process your visa. We have to deal with this sometimes, its usually not a problem. Both passports are required however.
PS> YOU MAY WANT TO BRING BOTH TO CHINA ALSO, JUST UNTIL THE RESIDENCE FORMALITIES ARE HANDLED AND YOUR NEW PASSPORT HAS THE RES. STICKER IN IT.
