Hi, I am researching the best way for me to get a Z-visa for travel to China in mid-September. I am currently in Beijing but must leave for the states because I overstayed my L visa duration by 16 days.
Because of this violation I had to go through a lengthy process of going to the PSB to apply for a special Exit visa to even leave the country! That took a full 7 days during which you are not permitted to leave China. Even if you have proof of travel, you are forced to wait at least 7 full days before you can leave China. That meant I had to change my flight itinerary and pay flight change fees on top of the 3000RMB fine for overstaying and the 940RMB for the cost of the special Exit visa.
Do you feel this overstay will negatively affect my ability to get a Z-visa?
I heard from a friend that works at an embassy that this penalty may be seen on my passport when applying for a Chinese visa and they might deny me for this reason. He had suggested that I lose my passport because the replacement passport would have a clean record.
However, does that make any sense?? I assumed that all violations of visas would be connected to your passport number so even if you get a replacement passport, it would still have the same passport number from before, and therefore show record of all the previous violations.
In addition, my most recent China visa has a red stamp on it that says "CANCELLED". The red stamp makes me feel even worse about my ability to get a Z-visa!
As for the Z-visa I already have a company that will hire me and do all the paperwork for the visa (foreign experts work permit/alien employment license, and official visa notification). However, this company has never done this before so they aren't exactly sure what documents I need to provide for them.
I also previously had done a medical checkup in Beijing that is good for another 4 months. Lastly, my parents recently bought property in Beijing for which I am supposed to manage because they do not plan to travel to China often.
Do any of these points help me in getting my Z visa done from the states??

Yes. Unfortunately it will. We have had to deal with this several times already. The result was not pretty, as explained they (consuls) said that it would be another 2 years before those folks could re-apply for a visa. You can try it, it will be expensive no matter you do it yourself or through a visa agency, but I would recommend trying it no matter what. Even though many get rejected, there is still the chance.

Thanks very much for your reply. So a 16 day overstay is a big problem huh?
What do you think about my friend's suggestion for me to lose my passport to get a new one re-issued?
Do you feel rules may be relaxed by October or later in 2008/2009?

I see where you are going with this, and its not a bad idea but..
I dont know how you would solve the problem with the visa though with a new passport, you would have to take care of that at the local PSB, and they are likely to have a record of you being there (if you registered) and then its sour milk and cookies again I think. It seems like an equal expense and hassle. I think the problem is that you've overstayed by more than a polite amount of days. That is sure to be noticed by someone at sometime even with a new passport. Anyway, please let us know how this turns out in case anyone else overstays and has this problem.
