Hi, this is a little off topic, but I'm not sure where else here I'd post it.

If I want to start a small restaurant with a Chinese friend, does anyone know the legal implications and how this would work?
How this ties in with Visas and what I should expect?

Any comments are very appreciated.

Hi Matty,

You would need to setup a JV with an eligible Chinese business partner. There is some financial capital requirements, which need to sit in a bank until the business registration process is completed (usually about three to six months.) The good news is, that once your registration is approved, you can take out a certain percentage of that capital investment if you want. The legal issues are beyond the scope of time I have to write this, however, for your visa - your JV business partner should apply at the local ministry of foreign affairs, and or ministry of labor to apply for a special invitation document allowing you between 90-180 days multiple entry visa. Its harder to get these days but doable.

Tell me more, which province, city are you planning to carry this out? (Each location has various capital requirements.)

Restaurants can be very profitable in China, however, if you are a newbie to China.. I really suggest you do this wisely and with someone you trust completely.
Also, what is the town size where you are planning to setup shop? If a small town, expect to be visited by the tax adminiustration gangs.. They will be looking for their monthly kickback to keep them off your back plan to take them out to dinner twice per month.. Fail to do it one time, and expect some drama to which only they can rescue you.. Then expect to owe them favors.. (all by design of course.)

Dont throw all your money into this venture.. Thats my advise..
